Although the Infrastructure Security Compliance Division (ISCD) - the component of the Department of Homeland Security responsible for the development and enforcement of the Chemical Facility Anti-Terrorism Standards (CFATS) - continues to review Site Security Plans, Congress still has not delivered permanent CFATS authorization.
Since the inception of the regulation (nearly five years ago), CFATS has been continued through a series of ad hoc legislative extensions. Much to the disappointment of industry (and perhaps ISCD), a long-term CFATS authorization has been elusive for many reasons. Earlier this year, however, members of Congress from both parties introduced several legislative proposals that would extend CFATS for several years. Among them was H.R. 908, the Full Implementation of the Chemical Facility Anti-Terrorism Standards Act of 2011.
Introduced by Tim Murphy (R-PA) and Gene Green (D-TX), H.R. 908, would extend CFATS - in its current form - for six years, until 2017. On May 4, 2011, the House Energy and Commerce Committee's Subcommittee on Environment and the Economy marked-up H.R. 908 and passed the measure by a voice vote. The legislation now goes to the full Committee for consideration
